This is an ABSOLUTE AUCTION to the highest bidder!

A sample purchase agreement will be posted under documents.

Ernest Money Deposit due upon the fall of the hammer is $3000.00 to be paid in verifiable funds. The $3000.00 earnest money deposit shall be sent or delivered to the auctioneer broker via express mail or overnight letter. Acceptable deposits in US funds include good check, cashier’s check, wire transfer (call for wiring instructions) and cash.

A $2500.00 Auction service fee will be charged to the buyer of this property, said auction service fee is due upon closing of the deed. The property will convey free and clear of any liens or back taxes. The seller is responsible for HOA fees up until closing. The property will convey by a General Warranty Deed. Closing is to occur on or before Sept. 30th, 2014. Time is of the essence with this transaction. The property is being sold ‘AS IS, WHERE IS”.

Default: By the Seller. Should the Seller not be able to convey the property free and clear of liens or back taxes, the Buyer will be refunded their deposit. This shall be the sole remedy for the buyer.

Default: By the Buyer. Should the Buyer not close for any reason with the Seller being able to produce free and clear title the Buyer shall forfeit to the Seller the entire deposit earnest money. The Seller also reserves the right to seek damages from the Buyer.

The Buyer will be responsible for paying ALL Closing costs associated with this transaction, regardless of what the local custom may be including the current year property taxes. The Buyer’s closing fees include the new deed preparation charge, document recording tax stamps, attorney closing fees, title inspection, recording fees, title insurance, insurance, etc.

Notice of Agency: The Auctioneer/Broker is acting as an agent for the Seller in this Transaction.

The auction company is not responsible for mishaps that could happen with Internet bidding such as Internet being down or phone service not functioning and unavailable during the bidding time scheduled to sell this property. In the event of any legal proceedings the exclusive and sole venue shall be held in Greenbrier County West Virginia.
